These Terms of Service (“Terms”) govern your access to and use of the PetroLink platform, websites, mobile applications and related services (collectively, the “Services”) provided by Encipher Company Limited (“PetroLink”, “we”, “us” or “our”). By using the Services, you agree to these Terms.
1. Acceptance of terms
By creating an account, accessing or using PetroLink, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you may not use the Services. If you are using PetroLink on behalf of a business, you represent that you have authority to bind that business.
2. Description of services
PetroLink is a fuel retail operations platform that helps stations, chains, fleets and distributors manage forecourt operations, tank inventory, sales, deliveries, reconciliation, analytics and integrations. Features and availability may vary by subscription plan.
3. Accounts and responsibilities
You are responsible for:
- Providing accurate account and business information.
- Maintaining the confidentiality of your login credentials.
- All activity that occurs under your account.
- Ensuring your use of PetroLink complies with applicable laws, regulations and industry standards.
4. Subscription and payments
Some PetroLink features require a paid subscription. Fees are charged according to the plan you select and are billed in advance unless otherwise agreed. All payments are non-refundable except where required by law. We may change pricing by providing notice in advance.
5. Acceptable use
You agree not to:
- Use PetroLink for unlawful, fraudulent or harmful activities.
- Reverse engineer, copy, modify or resell the Services without authorization.
- Interfere with the security, availability or performance of the platform.
- Upload viruses, malware or other harmful code.
- Use the Services in a way that violates the rights of others.
6. Data and content
You retain ownership of the operational data you enter into PetroLink. You grant us a limited license to host, process and display that data solely to provide the Services. We will handle your data in accordance with our Privacy Policy.
7. Intellectual property
PetroLink and its content, trademarks, software and designs are owned by Encipher Company Limited or its licensors. These Terms do not grant you any right to use our branding, logos or software except as necessary to use the Services.
8. Third-party integrations
PetroLink may connect with third-party services such as EFD devices, tank gauges, mobile money providers and ERP systems. Your use of those integrations is subject to the third party’s terms and conditions. We are not responsible for the availability or accuracy of third-party services.
9. Limitation of liability
To the maximum extent permitted by law, PetroLink and Encipher Company Limited shall not be liable for any indirect, incidental, special, consequential or punitive damages arising from your use of the Services. Our total liability for any claim shall not exceed the amount you paid us in the twelve months preceding the claim.
10. Termination
You may stop using PetroLink at any time. We may suspend or terminate your access if you violate these Terms, fail to pay fees, or if required by law. Upon termination, your right to use the Services ceases immediately, though certain provisions of these Terms will survive.
11. Changes to terms
We may modify these Terms from time to time. We will notify you of material changes through the platform or by email. Your continued use of the Services after changes take effect constitutes acceptance of the revised Terms.
12. Governing law
These Terms are governed by the laws of the United Republic of Tanzania, without regard to conflict of law principles. Any dispute shall be resolved in the courts of Dar es Salaam, Tanzania.
